2. Eligibility and Registration

5. Premium Features and Digital Content

Where legally permitted and relevant for a paid digital feature, the user may be asked during the purchase process to expressly consent to immediate performance before the withdrawal period expires and to acknowledge that the right of withdrawal is thereby lost once performance begins.

Nothing in these Terms limits mandatory statutory rights relating to defective digital products, non-performance, withdrawal, reimbursement or termination.

7. Payments and Refunds
Payments for paid digital features may be processed either by the operator directly or by a merchant of record / authorized reseller identified during the purchase process.

The applicable contracting party, payment methods, payment terms, refund rules and chargeback handling are determined by the offer displayed during checkout and, where applicable, the terms of the merchant of record / authorized reseller.

Unless mandatory law provides otherwise, payments for digital features already properly supplied are non-refundable. This does not affect statutory withdrawal rights, statutory rights in case of defects, or any expressly granted refund policy.

If a payment is reversed, cancelled, charged back, fraudulently made or otherwise not successfully completed, the operator may suspend or restrict the affected account or digital features until the matter is resolved.

8. Availability, Maintenance and Changes
The operator does not guarantee uninterrupted, secure or error-free availability of any browsergame.

Maintenance, updates, balancing, anti-cheat measures, technical issues, security incidents, force majeure, third-party outages or other circumstances beyond the operator’s reasonable control may lead to temporary interruptions, delays, resets, balancing adjustments, data changes or functional limitations.

The user may terminate the contractual use relationship at any time, unless a specific paid offer provides for a fixed minimum term.

Termination or suspension does not automatically entitle the user to reimbursement, except where mandatory law or an expressly applicable refund rule provides otherwise.

10. Intellectual Property
Unless otherwise stated, all rights in the browsergames and in all associated content made available by the operator, including software, databases, layout, design elements, game mechanics, graphics, texts, logos, audiovisual elements and digital assets, are owned by or licensed to the operator and are protected by applicable intellectual property laws.

11. Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted under applicable law, including liability for intent, gross negligence, fraud and liability for injury to life, body or health.

To the extent permitted by applicable law, liability for slight negligence shall be limited to breaches of essential contractual obligations and to the foreseeable damage typical for this type of digital service.

Any further mandatory statutory rights and remedies remain unaffected.

12. Governing Law
To the extent legally permissible, these Terms shall be governed by the substantive law applicable at the registered seat of the operator identified in the Legal Notice / Imprint above.

If the user is a consumer habitually resident in a jurisdiction whose mandatory consumer protection laws apply notwithstanding a choice-of-law clause, such mandatory protections shall remain unaffected.
